Terms of Service

These terms are the agreement between you and HUGRUN Pty Ltd ("HUGRUN", "we", "us") for your use of HUGRUN Cloud. We've tried to write them in plain English. By creating an account or using the service, you agree to what's below.
1. Acceptance
When you sign up for HUGRUN Cloud, or use any part of the service, you accept these terms and our Privacy Policy. If you don't agree, don't use the service.
2. Your account
- You're responsible for keeping your login credentials safe.
- You agree to give us accurate information when you sign up.
- You're responsible for anything that happens under your account.
- Let us know straight away if you suspect unauthorised access.
3. Acceptable use
HUGRUN Cloud is a tool for legitimate business communication. You agree not to:
- Send spam, unsolicited bulk email, or anything that breaches anti-spam laws.
- Use the service for illegal activity, harassment, or hate speech.
- Attempt to break, disrupt, or probe the service for vulnerabilities.
- Reverse engineer, decompile, or copy the software.
- Resell or sublicense access without a written agreement.
- Use the service to train competing AI products on our infrastructure.
We can suspend or terminate accounts that breach these rules. Where the breach is minor, we'll usually warn you first.
4. Plans and billing
- Starter tier — AUD $29 per month. 5 emails per day.
- Pro tier — AUD $79 per month. 20 emails per day plus the AI Quote Generator.
- Founders Edition — AUD $499 one-time payment for lifetime access to the Pro tier. Limited to the first 50 customers.
- Annual plans save approximately 17% (two months free) and are billed up front.
- All prices are in Australian dollars and exclude GST where applicable. Customers in other currencies are charged the equivalent at checkout time.
- Monthly plans are recurring and cancel anytime from your dashboard.
- Payments are processed by Stripe Inc. By subscribing you also agree to Stripe's terms of service.
5. Auto-renewal
Monthly subscriptions automatically renew at the end of each billing period using the payment method on file, unless you cancel before the renewal date. You can cancel at any time from your account settings.
6. Refunds
- Monthly plans may be eligible for prorated refunds at our discretion — contact us and we'll be reasonable.
- The Founders Edition is refundable within the first 30 days. After 30 days it is non-refundable but provides lifetime access to the Pro tier.
7. Service availability
- We aim for 99.5% uptime across the platform.
- Scheduled maintenance windows are announced in advance.
- Standard plans do not include an SLA. Enterprise customers can negotiate an SLA separately.
- We depend on third-party providers (Stripe, Anthropic, OpenAI, Google, Microsoft, DigitalOcean). Outages there can affect us, and we can't always prevent them.
8. Your data
- You own your data. Always.
- You grant us a limited licence to process your data for the sole purpose of providing the service.
- You can export your data at any time from the dashboard.
- On cancellation, we retain your data for 30 days (a grace period in case you change your mind) and then delete it.

9. AI-generated content
- HUGRUN Cloud uses AI to draft emails, quotes, and other content for you.
- AI systems can make mistakes. They can hallucinate details, misinterpret context, or produce responses that don't match your intent.
- You are responsible for reviewing and approving every AI-generated message before it is sent to a customer.
- Final responsibility for anything sent from your account rests with you, not HUGRUN.
10. Use at your own risk, warranty disclaimer, and limitation of liability
- You use HUGRUN Cloud at your own risk. You are responsible for reviewing every draft, quote, email, and action HUGRUN produces before it is sent, approved, or relied upon. HUGRUN is a tool that assists you — it does not replace your judgement, your business decisions, or your obligation to supervise what goes out from your account.
- The service is provided "as is" and "as available", without warranties of any kind — express, implied, or statutory — beyond those that cannot lawfully be excluded under Australian Consumer Law. We do not warrant that the service will be uninterrupted, error-free, secure against every possible attack, or fit for any particular purpose specific to your business.
- AI output is not infallible. HUGRUN uses third-party AI models (including Anthropic Claude, OpenAI, and Google Gemini) to read emails, draft replies, and generate quotes. AI output can be inaccurate, incomplete, or wrong. You agree to review every draft and generated quote before sending, approving, or acting on it, and you accept that any financial, reputational, or legal consequence of acting on AI output without review is your responsibility, not HUGRUN's.
- You must review every AI-generated draft before it is sent. HUGRUN never sends, approves, or acts on anything by itself. Every email, reply, and quote requires your review and your explicit action to send it. You accept full responsibility for everything that leaves your account, and you agree that any failure to review AI-generated output before sending, approving, or relying on it is your risk, not HUGRUN's.
- Not professional advice. HUGRUN and its AI output do not constitute legal, financial, tax, accounting, or other professional advice. You are responsible for obtaining your own professional advice before relying on anything the service produces.
- We rely on third-party services. HUGRUN depends on external providers including Anthropic, OpenAI, Google, Microsoft, DigitalOcean, and Stripe. When those providers experience outages, rate-limits, policy changes, or data loss, HUGRUN may also be affected. We are not liable for any loss arising from a third-party provider's action, inaction, outage, or service change.
- Total liability cap. To the maximum extent permitted by law, HUGRUN Pty Ltd's total aggregate liability to you — across all claims, causes of action, and theories of liability combined — is limited to the lesser of (a) the total fees you have paid us in the 12 months preceding the claim, or (b) AUD $500. This cap applies whether the claim is in contract, tort (including negligence), statute, or any other legal basis.
- No indirect damages. We are not liable for indirect, incidental, special, consequential, or punitive damages — including lost revenue, lost profits, lost customers, lost goodwill, lost data, business interruption, or substitute service costs — arising from your use of, or inability to use, the service. This exclusion applies even if we have been advised of the possibility of such damages.
- Account security is your responsibility. You are responsible for keeping your password, recovery codes, and connected email account secure. HUGRUN is not liable for losses caused by unauthorised access to your account where the cause was not our direct fault.
- Australian Consumer Law preserved. Nothing in these terms excludes, restricts, or modifies any right you have under the Australian Consumer Law that cannot lawfully be excluded, restricted, or modified. Where a right cannot be excluded but our liability can be limited, our liability is limited — at our option — to re-supplying the service or refunding the amount you paid for it.
11. Termination
- You can cancel your subscription at any time from your dashboard.
- We can terminate or suspend accounts that breach these terms, with notice where possible.
- The Founders Edition is non-refundable after 30 days, but provides lifetime access to the Pro tier for as long as the service operates.
- If we ever wind down the service, we'll give you reasonable notice and a way to export your data.
12. Governing law
These terms are governed by the laws of Victoria, Australia. Any disputes will be resolved in the courts of Victoria.
13. Changes to these terms
We may update these terms from time to time. If the changes are material, we'll notify active account holders by email before they take effect. Continuing to use the service after the change means you accept the new terms.
14. Anti-spam and acceptable email use
HUGRUN Cloud connects to your inbox and helps you draft replies. You — not HUGRUN — are the sender of every message that leaves your account. You agree that:
- You will only send messages in compliance with the laws that apply to you, including the Spam Act 2003 (Cth) in Australia, CAN-SPAM in the United States, CASL in Canada, PECR in the United Kingdom, and ePrivacy in the European Union.
- You will not use HUGRUN to send unsolicited marketing email or anything that resembles spam.
- You will only contact people who have a pre-existing business relationship with you, or who have explicitly consented to receive your messages.
- HUGRUN reserves the right to terminate accounts found to be sending spam and to cooperate with anti-spam authorities investigating abuse.
15. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless HUGRUN Pty Ltd, its directors, employees, and contractors from and against any claim, demand, action, loss, damage, liability, cost, or expense (including reasonable legal fees) brought by a third party and arising out of or in connection with:
- any message, reply, or quote sent from your account, whether or not it was drafted with HUGRUN's assistance;
- content, data, or contact details you upload, import, or otherwise process through the service, including your responsibility to have a lawful basis and any required consent to process them;
- your reliance on AI-generated output that you sent, approved, or acted on without reviewing it first;
- your breach of these terms, your acceptable-use or anti-spam obligations, or any law that applies to you; and
- your infringement of any third party's rights, including privacy, intellectual property, or reputation.
This obligation survives the termination or closure of your account.
